Texas School & Daycare Fire Alarm Inspection and Testing Requirements
Texas School & Daycare Fire Alarm Inspection Requirements
Private Christian schools, Montessori schools, preschools and licensed child-care centers do not all have the same fire safety inspection obligations. The applicable requirements depend on child-care licensing, educational exemptions, building occupancy, and the local authority having jurisdiction (AHJ).
Day Care Fire Inspection Preparation Checklist (PDF)
Download the Day Care Inspection Checklist (PDF) for a practical reference when preparing for fire and life-safety inspections. Review it alongside the applicable Texas child-care licensing requirements and your local fire marshal’s requirements; the checklist does not replace either authority’s current rules.
Three Different Fire Safety Responsibilities
- Fire marshal facility inspections: For regulated child-care centers, 26 TAC §746.5101 generally requires an initial fire inspection and another at least every 12 months, subject to the public-school-facility exception. The inspection is performed by the state or local fire marshal.
- Fire alarm system inspection and testing: Installed systems must be maintained and tested in accordance with the applicable adopted fire code, NFPA 72 and licensing rules. For applicable child-care centers, 26 TAC §746.5315 specifically requires an electronic smoke alarm system to be tested at least annually by the monitoring company or state or local fire marshal, with records retained.
- Monthly smoke detector tests: For regulated child-care centers, 26 TAC §746.5319 requires the director or designee to test all smoke detectors monthly, document the date and employee performing the test, and retain the records at the center for review. A similar requirement for regulated school-age and before/after-school operations appears in 26 TAC §744.3619.
Which Schools Need Annual Fire Marshal Inspections?
Licensed child-care centers: Generally yes, under 26 TAC §746.5101, except for qualifying centers located in public school facilities operated by local independent school districts.
Regulated school-age and before/after-school programs: Generally yes, under 26 TAC §744.3501, subject to the corresponding public-school-facility exception.
Private Christian K–12 schools, Montessori schools and exempt private preschools: There is no universal statewide annual fire marshal inspection mandate merely because the facility is a private school. Determine whether the operation is licensed, exempt or includes a separately regulated child-care program, and check local AHJ requirements.
Monthly Testing Is Not the Same as Contractor Inspection
The monthly smoke detector test required of certain child-care operators is an operational responsibility. It does not authorize unlicensed employees to service, reprogram or perform regulated inspection and testing on commercial fire alarm systems. Facilities with addressable or centrally monitored fire alarm systems should coordinate approved testing procedures with their licensed service provider and AHJ to avoid unintended alarm dispatches or system impairments.
Other Monthly Responsibilities
Under 26 TAC §746.5307, a child-care center director or designee must inspect fire extinguishers monthly and record the date and employee. Under 26 TAC §746.5537, applicable standalone electric or battery-operated carbon monoxide detectors must be tested monthly, with documentation; connected electronic CO detection systems have separate annual testing provisions.
Practical Compliance Checklist
- Confirm the school's or center's licensing and exemption status.
- Identify the adopted local fire code and AHJ.
- Keep required fire marshal inspection and professional system testing reports.
- Maintain monthly smoke detector testing records where required.
- Record deficiencies, corrective actions and any system impairments.
- Ask your licensed fire alarm provider to establish a safe, approved testing procedure for your equipment.
